I'm sorry, there is no coverage for this accident.!!!
THESE ARE WORDS YOU DO NOT WANT TO HEAR AFTER YOU TURN IN A CLAIM,
UNFORTUNATELY, THERE ARE A COUPLE OF OTHER REASONS WHY THIS MIGHT
LEGITIMATELY BE SAID:
[8] Since not all auto insurance is the same, there are a few
questions you need answers to. What are the questions? A few are
listed below, there are more in the book.
*
YOU DID NOT BUY THE COVERAGE WHEN YOU PURCHASED THE POLICY
*
OR THE COVERAGE IS TAKEN AWAY IN THE EXCLUSION SECTION OF THE POLICY.
SOLUTION
Most Auto Insurance companies that offer online quotes, discount car
insurance quotes, or compare car insurance quotes, or market on the
web, through TV or other mass media want you to believe that all auto
insurance polices are identical. They want you to believe that
Insurance is like a commodity. _The question is, how will you know if
it is or not?_
When you ask for a free online quote or respond to an ad that
offers instant car insurance quotes, how will you know you are getting
the best car insurance for the money? What do you ask the agent
helping you to help you make up your mind? When asking people what
they are looking for almost everyone answers the question by saying
they are looking for the lowest price car insurance quote or they just
want to get it over with.
Could this happen to you?
The Eichenberger family of Iowa had a rude awakening in the summer
of 2007 when they discovered their group health insurance policy had
an exclusion they did not know about. Mr. and Mrs. Eichenberger were
farming but both were employed at off farm jobs. Mr. Eichenberger did
the farming in his off time. A very common situation in rural states.
Mr. Eichengerger was injured in a farm accident. His recovery
period was long. The surprise came when they were notified that the
group health policy that he was insured under had an exclusion in it
that stated that if the illness or injury arose out of or in the
course of employment/activity for wage or profit then that activiity
was excluded from coverage.
Because he was farming for profit, his accident and thus injury
fell into that exclusion. The total claims are in the $300,000 range.
This information was reported in a major farm organization publication
for its members in March 2008.
How will this issue get resolved? It is hard to say. The
Eichenberger's may never collect on the claim, but it is a sure bet
there will a lot of finger pointing, hand wringing and attorney fees
before it is concluded. This family and those around them have learned
a hard lesson that any one of us could learn, and that is, not all
insurance is created equal. The fine print and exclusions are
important to understand.
_SO WHO IS TO BLAME FOR THIS HAPPENING?_ That is exactly what is
going to get hashed out in the coming months, but it is safe to say
that the Insurance company has not done nothing illegal by inserting
the exclusion. Insurance Companies put their policy forms (more on
forms later) together, then get appoval from the Insurance Department
to offer them for sale to the public, then market and put them in
place with very little fanfare. Hardly anyone reads the fine print. If
an exclusion in a polciy gives them a financial advantage over their
competition, it is not illegal. Just like it is not illegal to sell a
new car without a warranty. As long as the contract that you sign
states the exclusion clearly, even if you have not read it.
Since you have been financially harmed, you may think that you have
a case for a law suit. You may even be able to find an attorney to
take your case, but the facts are it is not illegal.
You may also be inclined to think this type of exclusion in a policy
is rare. You would be mistaken, however, because most claims are small
and any controversy relating to them go unnoticed, most people just
pay the bill and go about their business. This claim is large by most
standards, and the press and people are sitting up and taking notice.
One added bit of information that comes into play is that most
people who are covered under group health plans never see a policy.
They receive a certificate notifing them of coverage. The actual
policy is held by the company that offers the group coverage. There is
another lesson to be learned here in that if you are a worker for a
company and you want to know what your policy covers, go to your H.R.
department and ask to see a copy of the policy. Will they deny you? I
don't know, but there is lot riding on that document and what it means
to you. If you don't want to ask about the contract, ask to talk to
the agent who wrote the coverage. They should have an understandigng
of what is in the contract they sold. Keep in mind, it is not illegal
to include an exclusion in a policy.
_WHAT DOES THIS HAVE TO DO WITH UNDERSTANDING AUTO INSURANCE?_
As shown above, the trend for most people is to believe that all
insurance is created equal. They believe it is like a commodity. Most
people never think that there is or could be a significant difference
in the policies that are offered.
The fact is, when they find out there is a difference it is
generally after a claim is filed.
This author also has the opinion that people want to believe that
all insurance is the same and think if the coverages were important
the company would have included them.
Keep this in mind when you buy insurance, It is not the
responsibity of the agent to read your policy to you or for you, It is
your responsibility. Most people do not understand insurance
contracts, in fact, they generally hate insuranace and will just throw
their polices in a file until a new one is issued and then throw the
old one out.
_This lack of interest and understanding is exactly why you need
this book. _You see it isn't that you are not interested, it is that
you have to wade through all that language to get to what you want to
know and then when you get there you may not understand what you have
just read.
The knowlege that you will gain from this book is enough to make
sure that you are buying a quality product auto insurance product.
Does that mean the cheapest premium? Quality and cheapest rarely go
hand in hand, but it is safe to say that, when you know the secret to
buying the best insurance you will at least be aware of the short
comings of any policy you decide to purchase.
