Who's Suing You?


 

If you've recently discovered that you're being sued over an old debt, you're probably feeling pretty overwhelmed. The first thing you need to know is this: Being sued in court over consumer debt does not mean that you’re a bad person. Also, you have plenty of rights, and there are ways to reach a positive outcome. Like the majority of people who are sued over old debt, you’re probably being sued by a junk debt buyer.

 

Junk debt buyers are firms that buy old debt from credit card companies and other lenders. While they primarily purchase old credit card debt, they occasionally buy old auto loans, retail loans, telecommunication bills and other debts. In most cases, they buy these debts for pennies on the dollar. Once they own an old debt, they generally do whatever it takes to collect on it.

What Can You Do?

 

With the troubled state of the economy, more honest folks than ever are finding themselves trapped by high consumer debt, unsure of what to do next. Big businesses around the country use aggressive methods to intimidate people who, due to changing economic circumstances, find it difficult or impossible to pay off their debts. Some of the threats that they make to intimidate people into paying off their debts are legitimate; others are complete lies and must be challenged by the facts.

The most important thing to remember about consumer debt lawsuits is that because they are not criminal cases they cannot result in jail time for anyone involved. Many aggressive lawyers and companies will strong-arm people into paying more than they can afford by implying that they will go to jail if they don't, but this cannot happen...These lawyers often use such fear tactics when confronted by weak cases in the hopes that you, the Defendant, won't challenge their claims.

Most consumer debt cases follow a predictable pattern…After the barrage of threats, creditors will present their case to you in the hopes of forcing you into an unfavorable settlement. If this doesn't work, the next step is the courtroom. Again, consumer debt is not a criminal offense and cannot result in jail time for Defendants, but there are still consequences to losing a case in court. These include wage garnishment, where the court allows creditors to take a percentage of your paycheck each week, as well as bank account garnishment, which allows creditors to take monthly withdrawals from your bank account.
